Tek Networks Product Installation
Tek Networks ensures that we will install your solution according to the specifications outlined in the Tek Networks Customer Acceptance document. This document, which we complete with you after receiving your purchase order, will clearly define all key aspects of the solution. Installation charges will align with the pricing provided in our quotation.
Ongoing Support for Your Solution
While Tek Networks solutions are known for their reliability, the complexity of the environments in which they operate—often involving integration with various external systems, software applications, and your data infrastructure—makes a service agreement a valuable investment in continued performance and peace of mind.
Our comprehensive service agreements ensure that your systems and peripherals operate at their peak efficiency, minimizing downtime. We offer full on-site support, delivered by trained technicians, which includes labor and, when necessary, replacement of faulty parts. Our agreements also feature remote access capabilities, allowing quick response to system adjustments via phone, wherever possible.
If you opt out of a service contract, your system will still benefit from our three-year equipment warranty (subject to the warranty chosen), though labor costs will apply if any issues arise. Without a service agreement, we may not be able to provide immediate assistance due to prior commitments, but customers with service contracts receive priority and guaranteed response times to minimize disruptions.
Please note that certain products are only available with an ongoing service agreement.
Conditions of Service
Before any work on your systems or network, we assume you have up-to-date and complete backups of all data and software. If you are unsure of the state of your backups, we offer testing and verification services, but we limit our liability to the service cost billed. You must also have legal ownership or rights to use any software installed on your systems. We cannot install software unless you provide original copies.
Service Agreements
Service agreements typically cover a specified period (usually 12 months or longer), unless otherwise agreed at the time of order or classified as a casual arrangement. Cancelling before the end of the contract period will result in charges equivalent to the fixed costs for the remaining duration.
The contract period begins on the date of signature or the date the service is first delivered, whichever is later. In some cases, support contracts may not commence until onboarding or service delivery is complete. A one-month advance notice is required for any service cancellation to allow for proper disconnection and offboarding, which may include additional charges. If cancellation is requested mid-month, charges for the following month will still apply. For support services, if there is a significant reduction in assets, Tek Networks reserves the right to invoice based on a minimum of 75% of the original assets unless otherwise agreed. Early termination will incur charges based on the initial or agreed-upon quantities for the remainder of the contract period.
Service installations may take time, especially if infrastructure needs development before delivery. Should you wish to reconnect a previously cancelled service, this will be treated as a new installation and may involve additional charges.
Quotation Terms
When providing a quotation, it is your responsibility to identify any concealed services to avoid accidental damage. Any damage to hidden services will be your responsibility.
Unless otherwise specified, quotations do not include costs for concrete coring or cutting, surface restoration, painting, additional work due to hidden services or obstructions, services by third-party contractors, certifications, labeling, or signage. All quotations are valid for 14 days unless otherwise noted.
Payment Terms and Conditions
1. Definitions
i. Client: Refers to the individual or entity requesting services or goods, including anyone authorized to act on their behalf.
ii. Guarantor: The person(s) or entity who agrees to be responsible for the debts of the Client.
iii. Goods: Products provided by Tek Networks to the Client, which may also include services, as described in these terms.
iv. Services: Any services, advice, or recommendations provided by Tek Networks to the Client, including those related to the provision of goods.
v. Price: The agreed-upon cost of goods and services between Tek Networks and the Client, subject to any relevant clauses of this contract.
2. Acceptance
i. Any request for goods/services by the Client or acceptance of goods/services from Tek Networks implies acceptance of these terms.
ii. If more than one party is named as the Client, they are jointly and severally liable for payment.
iii. These terms are binding upon the Client’s acceptance and may only be changed with written consent from Tek Networks management.
iv. No representative of Tek Networks is authorized to make statements or agreements beyond those expressly authorized in writing by management.
v. The Client must provide at least 14 days’ notice for any changes in contact or business details.
3. Goods
i. Goods provided by Tek Networks will be as described in invoices, quotations, work authorizations, or other related forms.
4. Price and Payment
i. At Tek Networks’ discretion: a. The price will be listed in the invoice provided to the Client. b. Quoted prices will be honored for 14 days, contingent on written acceptance by the Client.
ii. Variations from scheduled work or specifications may result in additional charges, which must be paid upon completion.
iii. Payment terms will be specified on invoices or orders, and if not specified, payment is due upon delivery.
iv. For approved Clients, payment is due within seven days of the invoice date.
v. Payment methods include cheque, credit card, direct deposit, or any mutually agreed option.
vi. A deposit may be required, and its amount will be indicated when goods/services are ordered.
vii. Prices exclude GST and other taxes unless otherwise specified.
5. Delivery of Goods/Services
i. Delivery will be made to the Client’s specified address, and they must be prepared to receive the goods.
ii. Tek Networks may deliver in installments, each of which will be invoiced separately.
iii. The Client agrees to accept deliveries that may slightly differ in quantity, up to 5%, with the price adjusted accordingly.
iv. Failure to deliver does not constitute a breach of contract. v. Tek Networks is not liable for delays or failure to deliver goods.
6. Risk
i. Risk transfers to the Client upon delivery, regardless of retained ownership.
ii. If goods are damaged before payment is completed, Tek Networks retains the right to insurance payouts, regardless of whether the full payment is due.
7. Client’s Disclaimer
The Client waives any right to cancel or claim damages due to misrepresentation, acknowledging they are relying solely on their own judgment and not on any unwarranted claims by Tek Networks’ representatives.
8. Defects and Returns
i. The Client must notify Tek Networks in writing of any defects or discrepancies within seven days of delivery.
ii. Tek Networks, at its discretion, may replace or repair defective goods, provided the Client follows return policies and the goods are in their original condition.
9. Warranty
i. Tek Networks offers a limited warranty for defects in workmanship, valid within a specified period, subject to conditions.
ii. The warranty excludes damage due to improper use, failure to follow instructions, normal wear and tear, or unauthorized repairs.
iii. For non-manufactured goods, the manufacturer’s warranty applies. iv. For second-hand goods, no warranty is provided, and the Client accepts them as-is.
10. Trade Practices Act and Fair Trading Acts
Nothing in these terms seeks to exclude rights under relevant consumer protection laws.
11. Intellectual Property
Tek Networks retains ownership of designs it creates, and any designs supplied by the Client must not infringe third-party rights.
12. Default
i. Overdue payments will incur interest at a rate of 3.5% per month.
ii. Tek Networks may recover any costs associated with collection, including legal fees.
iii. Failure to pay may result in suspension of services or cancellation of orders.
13. Ownership of Goods
i. Ownership of goods remains with Tek Networks until full payment is made.
ii. Tek Networks may reclaim goods if payment is not received or if other obligations are not met.
14. Security and Charges
i. Tek Networks may secure debts through a mortgage or charge on any property owned by the Client or Guarantor.
ii. The Client/Guarantor agrees to cover legal costs and sign any documents necessary to enforce this.
15. Cancellation
i. Tek Networks reserves the right to cancel orders before delivery without liability.
ii. The Client may cancel services but must cover any costs incurred by Tek Networks up to that point.
16. Privacy
Tek Networks may collect and share personal information for the purpose of credit checks, marketing, or managing payments, in accordance with the Privacy Act of 1988.
17. Unpaid Goods
If goods remain unpaid, Tek Networks may dispose of them and recover any losses.
18. Lien and Stoppage in Transit
Tek Networks retains the right to hold or stop goods in transit if payment is not made.
19. General Provisions
i. Invalid provisions will not affect the remainder of the terms.
ii. These terms are governed by Queensland law.
iii. Tek Networks is not liable for indirect losses or expenses caused by breaches of contract.
iv. Liability for damages is limited to the price of goods or services provided.
v. Tek Networks may subcontract or change terms without the Client’s consent.
vi. Neither party is liable for defaults due to events beyond their control, such as natural disasters or industrial actions.
